R. v. M.C. et al. - Toronto SCJ - 2025 - Justin successfully argued a Charter Application before Justice McMahon to exclude a quantity of fentanyl and a firearm that was located in a house. The Court found that the search warrant should not have issued as a result of Police Officers’ evidence misleading the issuing Justice. As a result all of the evidence found within the house was excluded
R. v. C.B. - Toronto SCJ - 2025 - Client was charged with a possessing a kilogram of cocaine. The case came back for a second Trial after the first one resulted in a hung-Jury. Following a two-week long Trial, the Jury acquitted Justin’s Client of all charges.
R. v. S.P. et al. - Oshawa OCJ - 2025 - Client was charged with possessing multiple firearms. Justin secured his Client’s release on New Year’s Eve of 2024. Two months later Justin highlighted issues with the Crown’s case and all charges against his Client were withdrawn.
R. v. T.J. et al. - Toronto SCJ - 2025 - Client was charged with a series of gunpoint carjackings. Justin successfully resisted a Crown Pre-Trial Application to have Youth Records admitted. The Trial was scheduled to take place over 6-weeks. On the 2nd day of Trial Justice McArthur Acquitted Justin’s Client of all charges.
R. v. J.S. - Toronto SCJ - 2025 - Client was charged with possessing 100 gms crystal methamphetamine, 200 gms cocaine and 23 gms of fentanyl for the purpose of trafficking. Upon reviewing Justin’s persuasive Charter materials, the Federal Crown Attorney stayed all the charges
R. v. X.H. - Toronto OCJ - 2023 - Client was charged with multiple sexual assault and domestic violence allegations on his wife. All charges were withdrawn two weeks before the Trial was scheduled to start.
R. v. J.F-P. et al. - Toronto SCJ - 2023 - Client was charged with offences relating to possessing a firearm in a motor vehicle. Following a Trial where Justin highlighted the deficiencies of the Police Investigation, the Jury returned with not guilty verdicts on all counts.
R. v. D.Q.L - Toronto OCJ - 2023 - Toronto - Client was charged with assault with a weapon and utter threats after an altercation involving a meat cleaver. Crown withdrew all charges against the Client after Justin’s involvement.
R. v. B.R. et al. - Toronto SCJ - 2023 - Client was charged with human trafficking related charges. The matter went through a preliminary inquiry and the Trial was rescheduled numerous times due to Covid and coaccused delay. Before the start of the scheduled Jury Trial, Justin successfully showed evidence to the Crown to convince her to withdraw all the charges. Client is able to continue her life without a criminal conviction or criminal record.
R. v. L.R. - Toronto OCJ - 2023 - Client was charged in a domestic context with assault, forcible confinement etc. Crown withdrew charges days before the Trial was set to begin as a result of Justin demonstrating the strong issue with the Crown’s evidence, the state of disclosure and the s. 11(b) delay issues
R. v. J.F-P. - Toronto SCJ - 2023 - Client was charged with possessing a loaded firearm. During the course of the investigation, the Police accessed fingerprints that the RCMP kept in their database. Justin successfully argued that the RCMP held onto fingerprints that they were legally obligated to destroy. Justice Presser found that the Client’s Charter rights were infringed and evidence was excluded.
R. v. W.C. et al - Toronto OCJ - 2022 - Client and her husband were arrested for criminal negligence cause bodily harm and failure to provide necessities of life. After successfully securing Client’s release on bail, numerous bail variations and bail reviews were done so that Client could go about her daily life with as few restrictions as possible. The matter was scheduled for 3 weeks of Trial. Client’s innocence was always vehemently defended. As the Trial date approached Justin filed a s. 7 abuse of process application and the Crown withdrew all charges.
R. v. J.A. et al - Brampton OCJ - 2022 - Client was facing charges relating to possessing two firearms. After a contested bail hearing, Justin secured the Client’s release on bail and he able to go home to his family
R. v. S.F. et al - Toronto SCJ - 2022 - Client was charged with human trafficking, firearm and drug charges. Client had all of his charges stayed after Justice Leiper heard Justin’s arguments on the s. 11(b) Application for unreasonable delay.
R. v. M.G. - Toronto SCJ - 2021 - Client was charged with possession for the purpose of trafficking 3.75 ounces of carfentanil. After careful strategic planning, Justin decided to focus on the merits of the case, in doing so abandoning a s. 8 Charter application and elected to be tried by a Judge without a Jury. Client was acquitted after a week long Trial in the Superior Court of Justice.
